By accessing or using Elliott Cove ("Cove", "Service"), provided by Elliott Properties LLC ("Elliott Properties", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. Access is invitation-only and limited to active members of Elliott Properties and its authorized affiliates.
You must be at least 18 years old and a licensed real estate professional or authorized staff member of Elliott Properties. By using Cove, you represent that all information you provide is accurate and that you have authority to act on behalf of the brokerage account assigned to you.
You agree NOT to:
Cove includes AI-powered features (listing copy, marketing graphics, lead scoring, headshots, transaction insights). You are responsible for reviewing all AI output BEFORE publishing, sending to clients, or submitting to MLS. AI may produce inaccurate, biased, or non-compliant content. Cove is a tool — final judgment is yours and the brokerage's. We disclaim liability for any consequences of AI-generated content you choose to publish.
Where Cove charges fees (subscription, transaction, marketing services), you authorize Stripe to charge your designated payment method on the recurring schedule shown at signup. All fees are non-refundable except as required by law. We may change pricing with at least 30 days' notice. Failure to pay may result in account suspension.
When you connect third-party accounts (Gmail, Google Business Profile, Facebook, Instagram, LinkedIn, Stripe, DocuSign, SkySlope, etc.), you authorize Cove to access them on your behalf solely to deliver Service features. You can disconnect any integration at any time in Settings. Your use of those third parties is governed by THEIR terms — we are not responsible for their availability, content, or actions.
Elliott Cove, its software, designs, logos, and brand materials are owned by Elliott Properties LLC and protected by copyright and trademark law. You retain ownership of content you upload (your listings, photos, client data) and grant us a limited license to host, display, and process it for the sole purpose of providing the Service to you. This license ends when you delete the content or close your account.
Lead lists, client records, transaction data, and brokerage analytics inside Cove are confidential property of Elliott Properties. Upon termination of your affiliation with the brokerage, you may NOT retain copies, export to a competing system, or solicit clients sourced through Cove. Standard real estate brokerage non-compete and confidentiality provisions remain in effect independent of these Terms.
Your use of Cove is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Cove is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant uninterrupted availability, error-free operation, or that AI outputs will be accurate. Real estate transactions remain subject to your professional judgment, state licensing law, and your brokerage's policies.
To the maximum extent permitted by law, Elliott Properties LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages (including lost commissions, lost data, or business interruption) arising from your use of Cove. Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or $100, whichever is greater.
You agree to indemnify and hold harmless Elliott Properties LLC, its affiliates, officers, and employees from any claim, loss, or damage (including reasonable attorney fees) arising from (a) your use of Cove, (b) content you upload or publish, (c) your violation of these Terms, or (d) your violation of applicable real estate or consumer-protection laws.
We may suspend or terminate your access at any time, with or without cause, including upon ending your affiliation with Elliott Properties. You may close your account at any time by contacting support@elliottproperties.com. Sections 5, 7, 8, 9, 11, 12, 13, and 15 survive termination.
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Any dispute shall be resolved by binding arbitration in the county of Elliott Properties' headquarters, except that either party may seek injunctive relief in court for intellectual-property or confidentiality violations. You waive any right to a jury trial or class action.
We may update these Terms from time to time. Material changes will be announced in-app and by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
